ChildcareOS, LLC – Terms of Services & Conditions

ChildcareOS, LLC provides digital software, automation systems, onboarding, and consulting services for childcare centers. By purchasing or using our services, you agree to these Terms & Conditions.

All services are delivered electronically. No physical goods are shipped.

Payments are securely processed through Stripe and approved payment partners, including Klarna. Klarna’s terms apply where selected.

Welcome to ChildcareOS, LLC (“ChildcareOS,” “we,” “our,” or “us”). These Terms of Service & Conditions (“Terms”) govern your access to and use of our website, software, automation tools, services, and related platforms (collectively, the “Services”).

By accessing or using ChildcareOS, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility & Account Registration

You must be at least 18 years old and legally able to enter into contracts to use our Services.

You agree to:

Provide accurate, current information

Maintain the security of your login credentials

Be responsible for all activity under your account

ChildcareOS reserves the right to suspend or terminate accounts for false information, misuse, or violations of these Terms.

2. Scope of Services

ChildcareOS provides:

Enrollment automation tools

CRM and workflow automation

Tour scheduling systems

Parent and staff communication workflows

Business support tools for childcare operators

ChildcareOS is not a licensing agency, legal advisor, financial advisor, or regulatory authority. We provide tools and systems to support operations, but compliance with state, federal, and local childcare regulations remains the responsibility of the user.

3. Payments, Billing & Subscriptions

Fees are disclosed at the time of purchase or subscription

Payments are processed through third-party providers (e.g., Stripe, Klarna)

You authorize recurring charges if applicable

No Refund Policy

Due to the digital and service-based nature of ChildcareOS:

All sales are final

No refunds, chargebacks, or cancellations once services are delivered or access is granted

Any billing disputes must be submitted to [email protected] within 7 business days.

4. Service Fulfillment (No Shipping Policy)

ChildcareOS provides in-person and/or digital services.

No physical products are shipped

Access is delivered electronically via login credentials, email, or platform access

Service fulfillment typically begins within 1–3 business days, unless otherwise stated.

5. Acceptable Use Policy

You agree not to:

Use the Services for unlawful or fraudulent activity

Upload malicious code, spam, or harmful content

Attempt to access systems without authorization

Copy, resell, or redistribute ChildcareOS systems or content

Misuse SMS, email, or automation tools in violation of TCPA, CAN-SPAM, or local laws

Violation may result in immediate termination without notice and legal action taken.

6. Intellectual Property

All content, software, workflows, designs, branding, and systems are the exclusive property of ChildcareOS, LLC.

You are granted a limited, non-transferable, non-exclusive license to use the Services for your business only.

You may not:

Reverse engineer

Copy or duplicate workflows

Sell or license our systems without written permission

7. Third-Party Tools & Integrations

ChildcareOS integrates with third-party platforms including:

Payment processors

CRM tools

Messaging platforms

Automation services

We are not responsible for third-party outages, errors, policy changes, or security practices. Use of third-party tools is subject to their own terms and policies.

8. Data Responsibility & Compliance

You are solely responsible for:

Data you upload or manage

Consent from parents, staff, and contacts

Compliance with privacy, childcare, and communication laws

ChildcareOS is not liable for misuse of data or failure to obtain proper consent.

9. Limitation of Liability

To the fullest extent permitted by law:

ChildcareOS is not liable for indirect, incidental, or consequential damages

We do not guarantee uninterrupted or error-free service

Liability is limited to the amount paid for Services within the last 30 days

10. Indemnification

You agree to indemnify and hold harmless ChildcareOS, its owners, employees, and partners from any claims, damages, losses, or legal fees arising from:

Your misuse of the Services

Violations of laws or regulations

Breach of these Terms

11. Termination

We reserve the right to:

Suspend or terminate access at any time

Terminate accounts for violations, abuse, or non-payment

Upon termination:

Access to Services is revoked

No refunds will be issued

12. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

Any disputes shall be resolved in courts located in Georgia.

13. Changes to Terms

We may update these Terms at any time. Updates will be posted on our website with a revised effective date. Continued use constitutes acceptance.
